User Rights Policy

Rights of SwunkCraft users in good standing:

All people that are a part of the SwunkCraft community, be it in the Discord Server, Minecraft Server, or any other affiliated areas in good standing, meaning they have no previous or pending disciplinary action (hereby referred to as “User” or “Player”) are entitled to certain rights.

SwunkCraft is an equal opportunity environment. No player should feel discriminated against or targeted for their race, sex, sexual orientation, gender identity or expression, religion or lack thereof, age, color, national or ethnic origin, disability, marital status, familial status, pregnancy, genetic predisposition, domestic violence victim status, and veteran or military status and all other protected classes under the laws of the United States of America and the State of New York.

All users are entitled to a safe and welcoming environment that is family friendly. SwunkCraft should be welcoming to people of all ages, and players should not feel as though they can not participate because of the actions of another user.

All users are allowed to use all parts of SwunkCraft as permission is defined in the Terms of Service agreement. They are allowed to play on the Minecraft server, engage in the Discord server, and fill out forms and engage on the website.

Any violation that involves removing this safe and welcoming environment through the use of hate speech toward certain groups or other actions that are similar remove your right to an appeal of punishment, and can result in an immediate permaban.

All players are welcome to make their grievances heard about another player, or report wrongdoing using our discord server (http://discord.swunkcraft.net) and sending a message to ModMail, where it will then be reviewed and dealt with accordingly, in alignment with the Terms of Service (https://www.swunkcraft.com/ToS)

Rights of SwunkCraft users under disciplinary action:

All people that are a part of SwunkCraft and are under disciplinary review (which is defined as being inside of “Swunk Jail” in the Discord Server or being banned from the Minecraft Server pre-appeal) are entitled to certain rights. These rights are split into two categories:

1) First Time Offenders

A first-time offender is someone that has not been moved to the “Swunk Jail” section before and found guilty. All first-time offenders are entitled to know what they are being charged with, as well as know what the perspective punishment for their crime (without first making an appeal) would be. Charges will be given automatically, but perspective punishment will only be given upon request. All first-time offenders are entitled to make an appeal within a 24-hour period of being informed of what they are being charged with.

2) Repeat Offenders

A repeat offender is someone that has been moved to the “Swunk Jail” section before and was found guilty. Repeat offenders have the right to appeal their charges within a 12-hour period of being charged. Repeat offenders have the right to know what they are being charged with, as well as the recommended punishment without appeal (upon asking).

Rights of SwunkCraft users in poor standing:

A SwunkCraft user may be in poor standing if they have received a warn or have been found guilty, and have received disciplinary action from “Swunk Jail”. These players fit into four categories, that come with differing levels of privilege loss.

1) Players that have gotten a single warn

Players that have gotten a warn have all the same rights as a SwunkCraft user in good standing except they are forbidden from applying for staff positions. Users that only have one warning may apply for staff positions again if they maintain good standing for 2 months (8 weeks) and do not receive any further warns.

2) Players that have gotten multiple warns

Players that have gotten a warn have all the same rights as a SwunkCraft user in good standing except they are forbidden from applying for staff positions

3) Players that are currently tempbanned

Players that are tempbanned are forbidden from DMing anyone in the SwunkCraft Discord server, are not allowed to join the SwunkCraft Minecraft server, and are not allowed to fill out any forms on the SwunkCraft website. Other than that, they are allowed all the same rights as users in good standing.

4) Players that have been unbanned, or are currently serving out a different disciplinary action

Players covered in this section are allowed all of the same rights as a SwunkCraft user in good standing, but are not allowed to apply for a staff position, and are also constrained by the terms of their disciplinary agreement.

Rights of SwunkCraft users that have made purchases:

SwunkCraft users that have made purchases are entitled to collect the items that they have purchased, even if a bug effects the automation of this process. If a bug does occur, proof of purchase will be required to receive the perk that you have bought manually.

A SwunkCraft user is not entitled to a refund of a purchase if they choose to never log in again or if they are subsequently banned or punished for an offence that effects their purchase. A user is also in charge of canceling any subscriptions, even if they are kicked for inactivity or banned from the server. SwunkCraft is not liable for any continuing subscriptions after a ban or kick.

A SwunkCraft user is not entitled to any special treatment not defined within the purchase description just because they have made a purchase. They are still held accountable for their actions in the same way as any other SwunkCraft user.

Owning the SwunkCraft NFT does not give you any right to the SwunkCraft server or any additional privelages. Any user that purchases the SwunkCraft NFT will be treated the same as any other user of SwunkCraft.

Rights of SwunkCraft AdminTeam:

The members of the AdminTeam are expected to uphold the same rules as the rest of SwunkCraft. They are additionally expected to keep the community non-toxic and should assist any users in need of help. An AdminTeam member is subject to losing their status if they receive a warn or a ban. AdminTeam members are expected to remain active on the server as well.
